View Full Version : Custody jurisdiction question

My divorce took place here in Montana. Soon I will be moving to another state and my ex will be moving to a third state. Right now, any time either of us wants to modify the Parenting Plan in any way, we have to petition the State of Montana since they have jurisdiction over the child custody. Obviously once we both move, this will become a huge pain in the ass, not to mention costly because a lawyer will have to act on our behalf since we can't be present. Anyone know if, once I move, I can petition to have jurisdiction moved to my new state of residency?

Look up legal aid in your city, they should be able to advise you for free about what you need to do.

Unfortunately we don't have legal aid here (very small town). And the JAG on base won't get involved with or even advise on civil matters...
Thanks for the suggestion though! Guess I'll just wait til I get to the new place and see what I can do from there.

That sucks. What a tough situation, hopefully you will be able to resolve it when you move.
